States have taken different position on the legal personality of unborn human beings. A legal person possesses rights and is owed a duty of care. Some states consider non-viable unborn children to be legal persons (e.g., Alabama) and some do not (e.g., New York). Parents cannot bring a lawsuit for wrongful death on behalf of an unborn child who is not a legal person in the given state. The Alabama Supreme Court in its ruling (mentioning God 41 times) has now extended non-viable legal personality to frozen embryos.

I've been trying to understand the thinking and ultimate motivation behind this. My guess is that freezing embryos will be added to their forbidden/banned list?

My claim to fame is I went to school with (and lived in the same street!) as the first IVF baby. All the way from 4 to 16.

At this point, the crazier Southern state legislatures are just throwing crazy laws on the books to see what the Supreme Court will uphold. The Tennessee legislature just passed a law (that the Governor signed) that "allows state officials to decline to “solemnize marriages", with the goal being to chip away at Obergefell (the gay marriage law).

Someone said the way to put the embryos as children thing to rest is to claim frozen embryos as dependents on your taxes. I don't think that would work, but if there's a loophole.....
